1. About us and our service

1.1. study.and.travel ("study.and.travel", "we", "us", "our") operates the website study.and.travel and its related subdomains (the "Site"). We provide an online exam-practice platform with syllabus-aligned mock exams and AI-assisted grading (the "Services"). The Services available to you depend on your account type and, where applicable, your subscription plan (see section 4).

2. About these terms of service

2.1. Please read these terms of service (the "Terms") carefully before accessing or using the Site or any of the Services. By using the Site or Services you confirm that you accept and agree to comply with these Terms. If you do not agree, you must not use the Site or the Services.

2.2. If you use the Services in a professional capacity (for example, as a teacher, tutor, school or training provider) (a "Business User"), the additional clauses below marked for Business Users apply to you.

2.3. Our Privacy Policy explains how we handle personal data and is available at /privacy. Our Cookie Policy is available at /cookie-policy.

2.4. Your attention is particularly drawn to section 5 (warnings regarding the scope of the Services) and section 8 (limitation of liability).

3. Age restriction

3.1. If you are under 13, please do not register for an account or submit any information about yourself to study.and.travel, including your name, email address or any school-related information.

3.2. If it comes to our attention that we have unknowingly collected information from a person under 13, we will delete that information promptly.

3.3. If you are under 18 and you make use of the Services by purchasing any paid plan, you confirm that you have permission from the card holder (who must be 18 or older) to make any such payments.

4. Accounts, membership and payment

Registration

4.1. Some content on the Site is available for free (with each such user being an "Unregistered User"). Students can also access assigned mock exams via a class code without creating an account.

4.2. Teachers and Business Users register by signing in with an email magic link. To access paid features ("Full Content"), a Business User must purchase a subscription ("Subscription"). Subscriptions are priced per paid seat and renew automatically until cancelled.

4.3. The information you provide must be true, accurate and current. If any information you provide is inaccurate, incomplete or out of date, we may suspend or terminate your account.

4.4. Where any feature of the Site allows you to submit content (for example, answers, comments or other user-generated material), by submitting that content you grant study.and.travel a perpetual, worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of and display that content in connection with the Service. Any personal data contained in submitted content will be anonymised before it is made available to other users.

4.5. Keep your sign-in credentials confidential. Sign out when your session is complete. If you suspect unauthorised access to your account, contact us immediately.

4.6. Accounts are for individual use. Sharing your account or login details with other users is not permitted.

Charges and payment

4.7. To access Full Content, a Business User must purchase a Subscription on a recurring basis. You may cancel at any time.

4.8. We may review and update the amount, structure or timing of any charges. If a change would affect what you pay on renewal, we will give you at least 30 days' notice. If you do not agree, you may cancel before the change takes effect.

4.9. You will be billed in advance on a recurring periodic basis (the "Billing Cycle"), as set out in your selected plan.

4.10. A valid payment method is required. You must either be the authorised card holder or have permission from the card holder (18 or older) to use their card. By submitting payment information you authorise study.and.travel to charge the applicable fees to that payment method.

4.11. study.and.travel may run promotions or offers which may be subject to additional terms or restrictions published on the Site.

Suspension and termination

4.12. We may suspend access to the Services if we need to deal with a technical issue, make minor technical changes, or update the Services to reflect changes in relevant laws and regulatory requirements.

4.13. We may terminate the Services and your account with immediate effect (and claim any compensation due to us, where applicable) if:

• you don't make a payment when due and you still don't pay within 14 days of our reminder;
• you repeatedly breach these Terms;
• you share your account with another person or entity;
• we are unable to verify the accuracy or validity of any information you have provided; or
• we suspect fraudulent, abusive or illegal activity.

4.14. Where reasonable, we will contact you before suspension or termination and give you an opportunity to respond. We reserve the right to act immediately in cases involving suspected fraud, abuse or illegality.

4.15. You may terminate the Services at any time by cancelling automatic renewal in your account settings. If you cancel early, you will continue to have access to Full Content until the end of the period you have paid for, and you will not be entitled to a refund of sums already paid in advance unless required by law.

4.16. Where applicable consumer-protection law gives you a cooling-off period after purchase, you may cancel within that period for a refund. If you ask us to start providing Full Content before the cooling-off period ends and then change your mind, we may deduct a pro-rata charge for the Services already provided.

100% money-back guarantee

4.17. In addition to your statutory rights, study.and.travel offers a voluntary, outcome-based money-back guarantee on paid Practice Dashboard seats. In short: if a learner used study.and.travel to prepare and still failed their exam, contact us via /contact and we will refund 100% of what you paid for that seat.

4.18. To keep things fair, the guarantee applies where (a) the seat was paid for and active for the syllabus and tier the learner actually sat, (b) the seat shows genuine practice activity on the Practice Dashboard in the run-up to the exam, (c) the learner sat the official exam and received a fail grade as defined by the relevant exam board, and (d) you contact us within 90 days of the official result-release date with a copy or screenshot of the official result slip.

4.19. Approved refunds are processed via the original payment method (Stripe) and cover the seat fee only. The guarantee does not apply to no-shows, disqualifications, malpractice findings, or seats with no practice activity, and study.and.travel may decline a claim, acting reasonably, where it suspects fraud or abuse. Nothing in sections 4.17 – 4.19 limits your statutory rights as a consumer.

No other refunds

4.20. Other than (a) refunds expressly offered under the money-back guarantee in sections 4.17 – 4.19, (b) any cooling-off rights available under applicable consumer law (see section 4.16), and (c) any other rights that cannot be excluded under applicable law, all amounts paid to study.and.travel are non-refundable. In particular, we do not provide refunds or pro-rata credits for unused time, paid seats you decide not to use, accounts cancelled or suspended for breach of these Terms, or changes of mind once Full Content has been provided.

4.21. If you think you have been charged in error, please contact us through /contact before raising a payment dispute or chargeback with your bank or card issuer. We will investigate any billing question in good faith and put right anything that we have got wrong.

5. How to use the Services

Warnings regarding the scope of the Services

5.1. The Services, including all content on the Site, are intended for educational and general information purposes only. They are not, and do not constitute, legal, professional, medical, psychological, therapeutic or other advice.

5.2. We do not guarantee that the Site or the Services will be uninterrupted, error-free, reliable or timely, that defects will be corrected, or that the Services or any relevant server are free of viruses or other harmful components.

5.3. We make reasonable efforts to keep our content accurate and up to date, but we do not guarantee that any information or Services provided are valid, accurate, complete or fit for any particular purpose. Always check requirements published by the relevant exam board(s) and school. Reliance on the Services is at your own risk.

5.4. Any model answers, mark-scheme rationales, hints or AI-generated explanations represent our interpretation of an answer or solution. They are not held out as the correct or definitive answer to a given question. There may be other valid approaches.

5.5. study.and.travel is not liable or responsible if a student, teacher or third party incorrectly answers a question in any assignment, exam or other formal testing administered by a school or exam board, including where the method used differs from the one taught at the relevant school.

5.6. study.and.travel does not in any way guarantee any specific outcome in formal or informal academic testing.

Restrictions on use

5.7. When using the Site and the Services you agree not to:

• modify, download, reproduce, copy or resell any content on the Site beyond what these Terms expressly allow;
• use the Site or content for commercial purposes other than as permitted by a Business User Subscription;
• bypass any technical measure used to restrict access to any part of the Site;
• interfere with or damage the operation of the Site, including by uploading viruses, worms or other malicious code;
• reverse engineer, decompile or attempt to discover the source code or underlying algorithms of any part of the Site, except where permitted by applicable law;
• use the Site for any illegal purpose or in violation of any local, state, national or international law, including laws governing intellectual property and data protection;
• collect contact information from the Site for the purpose of sending unsolicited messages;
• impersonate any person or entity or misrepresent your identity or age;
• attempt to use another user's account or share your account credentials with any third party;
• post, upload or distribute content that is unlawful, defamatory, harassing, threatening, hateful, pornographic or otherwise inappropriate;
• upload private information of any third party (addresses, phone numbers, card numbers, etc.); or
• upload content that the operator of the Site reasonably considers objectionable or that may expose study.and.travel or its users to harm or liability.

No text or data mining, or web scraping

5.8. You must not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to the Site or any Services for any purpose, including the development, training, fine-tuning or validation of AI systems or models. This includes:

• any "robot", "bot", "spider", "scraper" or other automated device, program, tool or process used to access, copy, monitor or republish any portion of the Site; and
• any automated analytical technique aimed at analysing text and data in digital form to generate information or to develop, train, fine-tune or validate AI systems or models.

5.9. This section operates as an express reservation of our rights, including for the purposes of Article 4(3) of the Digital Copyright Directive ((EU) 2019/790). You do not have, and we do not consent to, any use of the Site or the data it contains for the development, training, fine-tuning or validation of AI systems or models.

6. Third parties

6.1. study.and.travel is not associated with and is not an agent of any third party, including any party named or linked on the Site.

6.2. We have no responsibility or liability for any content, products, advertising or other resources made available by any third party.

6.3. study.and.travel is a private, independent operator and is not affiliated with, sponsored by or endorsed by any exam board (including any exam board whose specification is referenced on the Site). Names and trademarks of exam boards are used only for nominative identification of the syllabus our content aligns with. Exam boards do not manage, check or engage in any quality control of our Services or content. Reliance on the Services is strictly at your own risk.

7. Copyright

7.1. All content and information provided on the Site or through the Services is protected by copyright, trademark and other intellectual-property rights. This applies to text, software, images, audio, video and any other material featured on the Site.

7.2. Except as expressly authorised by these Terms, you agree not to copy, reproduce, download, modify, translate, publish, broadcast, transmit, distribute, edit, adapt, upload, display, license, sell or otherwise exploit any content featured on the Site.

7.3. study.and.travel reserves all rights not expressly granted in these Terms.

8. Limitation of liability

8.1. study.and.travel is not responsible for losses you suffer caused by us breaking these Terms if the loss is:

• unforeseeable — not obvious that it would happen and you did not flag it to us before we accepted your order;
• caused by a delaying event outside our reasonable control; or
• avoidable — something you could have prevented by taking reasonable action (for example, by having your own anti-virus software).

8.2. For Business Users only. Subject to clause 8.3, we shall not be liable to Business Users, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with any contract between us. Our total liability to a Business User for all other losses arising under or in connection with any such contract shall be limited to the total sums paid by you to study.and.travel in the 12 months prior to the action or event giving rise to the liability.

8.3. Nothing in these Terms shall limit or exclude our liability for: (a) death or personal injury caused by our negligence, or the negligence of our employees, agents or subcontractors; (b) fraud or fraudulent misrepresentation; or (c) any matter in respect of which it would be unlawful to exclude or restrict liability.

9. Amendment of these Terms

9.1. We may amend these Terms from time to time. If a change is material to your use of the Services, we will notify you in advance and, if you do not agree, you can contact us to end your account before the change takes effect.

9.2. For non-material changes we will post the updated Terms on the Site, and they will apply from the date of posting. Please review these Terms each time you use the Services so you understand the terms that apply at that time.

10. Site maintenance and alteration

10.1. We will try to provide uninterrupted access to the Site and Services, but we may need to withdraw, modify, discontinue or temporarily or permanently suspend parts of the Service to reflect changes in relevant laws and regulatory requirements, or to make minor technical adjustments and improvements (for example, to address a security threat).

10.2. We may remove, alter or amend content on the Site, including content made available to Business Users, to update it, provided that the content continues to match the description that we provided to you before you purchased.

10.3. If we suspend supply, or notify you that we are going to suspend supply, for more than 30 days, you can contact us to end your Subscription. We will refund the price you paid for the suspended period, less a daily pro-rata fee for the Services already provided up to the time of suspension.

11. Governing law

11.1. These Terms are governed by English law. Wherever you live, you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland you may also bring claims against us in the courts of the country you live in. We may bring claims against you in the courts of the country you live in.
